What Is The Legacy Appeals Process

The legacy VA appeals process has changed to the decision review process.

What is the legacy appeals process. There could be hundreds of thousands of legacy claims still being processed. There are 2 steps in the legacy appeals process when you can opt in to the new decision review process or continue your appeal with the legacy process. All claims and appeals in the system prior to February 19 2019 that have not received a decision are called legacy claims. At this point in the legacy VA appeals process timeline you have filed your Form 9 within 60 days so the next step is for the Veterans Board of Appeals BVA to pick up your claim.

If you disagree with a VA decision dated on or after February 19 2019 you can choose from 3 decision review options Supplemental Claim Higher-Level Review or Board Appeal to continue your case. In other words all veterans filing for VA disability benefits go through the same steps and must adhere to the following appeal deadlines. The legacy appeals system only involves one lane in the veterans claims and appeals process. Most claims will be either granted or denied.

Appeals Average Days to Complete is 670 days. A legacy appeal is an appeal that was lodged before the 9th October 2015. The IAS is administered by the Independent Parking Committee Limited IPC. I am interpreting this to mean that it takes 525 days to get before a Judge.

The IPC is a trade body representing the interests of private parking operators. To as a legacy appeal with an opportunity to withdraw from the legacy system and enter the modernized system. Upon receipt of a Statement of the Case SOC or Supplemental Statement of the Case SSOC you may elect to continue your appeal by seeking review under one of the new review options.

You have two options once you file your VA Form 9. These claims and appeals are subject to the rules in force prior to February 19 2019. New Appeals System Both Appeals Systems are still Active Legacy refers to all appeals filed prior to New Appeals System launching February 19 2019 Legacy Appeals will STAY in the old system unlessuntil the veteran chooses to opt-in to New Appeals All appeals for decisions onafter Feb 19 2019 are in the new appeals system.

A legacy appeal is a disagreement with a VA benefits decision made before February 19 2019 the effective date of Public Law 115-55 the Veterans Appeals Improvement and Modernization Act of 2017 Appeals Modernization Act or AMA. Going forward all of the Statements of the Case will contain information regarding the process for opting in to the new system. If those forms were filed before February 19 2019 the claim would be processed under the Legacy Process and the VA should issue a Rating Decision which provides a summary of the decision on each claim.
